TERMS AND CONDITIONS
Reservations, Deposits & Documents:
Phone reservations will be held for 10 days, during which a deposit in the amount of $300 per person must be received. Payment of a deposit is deemed to be acceptance by the tour member and the agent of all terms and conditions regarding CHINASMITH's tour programs. All deposits must be paid by check. After the deposit is received, visa application forms for China will be forwarded with an invoice and document submittal schedule. Individual or group visa costs are included in the China tour price. Late fees apply if documents are received by CHINASMITH, INC. less than 10 days prior to departure. $50 per person of the deposit is a non-refundable processing fee applied if participation is totally cancelled. The full deposit is non-refundable if participation is cancelled after visas are obtained.
Payment for tours must be received 30 days prior to departure or on receipt of invoice, whichever is the shorter time period. Most major credit cards are accepted for final payment. Credit card payment requires a signed authorization form available on request. Credit card payments are usually separately processed for international air.
Airfares and Air Tickets:
International air for tours is on scheduled carriers. Fares set by the airlines are subject to change without prior notice. When rate changes can be protected by early ticketing, every effort will be made to inform each traveler to arrange for early payment. International air tickets are issued in New York and will be supplied to the traveler with passports and final documents.
Refunds after Full Payment:
Air tickets are refundable subject to the regulations of the airlines. If non-refundable fares are suggested for connecting flights, participants will be advised and CHINASMITH waives all responsibility for the cancellation penalties. International flights may be subject to penalties of as much as 50% if participants cancel without valid cause after any portion is flown. Airlines will usually waive penalties for cancellation due to death in a family or legitimate medical emergency. Air refunds are paid only after received by CHINASMITH, INC. from the airlines. If written notice of cancellation is received 8 to 21 days before scheduled departure, a maximum of 75% of the tour cost is refundable. Entire tour cost will be forfeit for cancellation notice received in writing less than 7 days before departure. The right to cancel any group departure with full refund is reserved by CHINASMITH.
Tour cost is based on packages provided by ground operators who are agents of CHINASMITH. Tour costs are unlikely to change unless there are extreme exchange rate fluctuations or surcharges by hotels or ground operators. Participants who have paid in full are protected from any exchange rate adjustments.
CHINASMITH, INC. is not responsible for any loss or damage of luggage or other personal belongings. Insurance for delays on all Yangtse Cruise itineraries is included in the published cost. Comprehensive tour cancellation insurance is available as an option.
Meals on all tours are included as noted on the specific itinerary. Usually meals feature a western breakfast with a Chinese or local style lunch and dinner. All transfers, service charges and porterage for luggage [two pieces weighing less than 20 kilograms (44 lbs.)] are included for the group tour. Independent travel by train does not include luggage porterage. A scheduled program of sightseeing is included each day. Individuals who choose not to participate in a given day’s activities may also forgo with no refund or compensation meals which are a part of the program. Tipping of local guides and drivers is expected. Gratuities given to a Tour Director at the end of a tour are at the participants discretion.
Health certificates are not required for China at this time. However, any physical or mental disability requiring special attention or treatment must be noted at the time of booking. Persons with RH-Negative blood should consult their physician before departure as this blood type is generally not available in China.
Costs Not Included:
Passport fees, photos, optional unscheduled sightseeing, and all personal items such as laundry, telephone calls, fax fees, etc.; beverages or meals other than those specified on tour programs, excess baggage charges. gratuities for personal services, insurance of any kind, local airport departure taxes.
No ATC or IATA carrier shall be liable for any loss, damage, injury, accident, delay or irregularity which may be occasioned by reason of defect or through the acts of omissions of any person or company performing or rendering the services other than carriage by air described in the tour brochure. The services described in this tour brochure other than carriage by air furnished by ATC or IATA carriers, are furnished by independent contractors who are not servants of or joint venturers or partners with any airline.
CHINASMITH, INC., located in New York City, its ground tour operators and their subsidiaries, jointly or severally act only as agents for the various companies and suppliers providing transportation, accommodations or other services. Payment to CHINASMITH for a tour program by an individual or a travel agent is deemed to be consent to the condition that CHINASMITH, its subsidiaries and/or agents shall not be liable in any way for injury or omission, howsoever caused by or arising out of any defect in any vehicle through neglect or default of any company, owner or supplier of transportation, accommodations or other services. Further, CHINASMITH, INC., its various agents and subsidiaries do not accept responsibility for any additional expenses which may be incurred due to delays or changes in the itinerary by reason of weather, labor or political unrest, terrorism, Acts of War or other Acts of God. Should such events occur, every effort shall be made to ensure the safety of tour participants and continuation of the planned itinerary. The right to cancel an individual from a tour is reserved. In such case an equitable amount will be refunded, not to exceed the total amount paid.
